PRIVACY POLICY

1. INTRODUCTORY PROVISIONS This privacy policy (hereinafter referred to as the “Policy”) explains how the controller processes the personal data of visitors to the website fotky.eu (hereinafter referred to as the “Website”). The controller of personal data is a natural person — the operator of the web portfolio (hereinafter referred to as the “Controller”). The processing of personal data is carried out in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation, hereinafter referred to as “GDPR”), Act No. 110/2019 Coll., on personal data processing, and Act No. 127/2005 Coll., on electronic communications.

2. IDENTITY AND CONTACT DETAILS OF THE CONTROLLER The Controller is a natural person who does not act within the framework of a business activity with an assigned identification number (IČO), however, in operating the Website, acts in the position of a data controller within the meaning of Art. 4 para. 7 GDPR.

3. SCOPE AND PURPOSE OF PERSONAL DATA PROCESSING The Website serves as a presentation of a photographic portfolio. The Website does not contain registration forms, contact forms, comment sections, or the possibility of creating a user account. The Controller does not collect identification data about you (such as your name, phone number, or address) that you would not actively provide yourself through other means (e.g., by e-mail). Automated processing occurs in the following scope:
A. Technical data and server logs Upon each access to the Website, the technical infrastructure (provided by the Wfolio platform) automatically records certain data that are technically necessary for displaying the Website and ensuring its stability and security.

  • Processed data: IP address (partially anonymized or logged for security), browser type and version, operating system, date and time of access, referring page address (Referrer URL), HTTP status codes.
  • Legal basis: The legitimate interest of the Controller (Art. 6 para. 1 lit. f) GDPR) in ensuring the technical operation, functionality, and security of the Website (e.g., detection and prevention of cyber attacks).
  • Retention period: Logs are kept for the time strictly necessary to ensure security, usually ranging from a few days to a few weeks, depending on the hosting provider’s settings.

4. USE OF COOKIES The Website uses only strictly necessary (technical) cookies for its operation. These cookies are absolutely essential to ensure the basic display, functioning, and security of the Website on your device. According to § 89 para. 3 of Act No. 127/2005 Coll., on electronic communications, these technical cookies are stored automatically because they are necessary for the provision of a service that you, as a user, have explicitly requested, and therefore your prior consent is not required for them. The Website does not use any analytical or marketing cookies, we do not track your behavior, and therefore we do not ask for your consent through a cookie banner.

5. RECIPIENTS OF PERSONAL DATA (PROCESSORS) AND TRANSFER TO THIRD COUNTRIES The Controller does not sell or rent your personal data to third parties. Only the technology provider (processor) who ensures the operation of the Website for the Controller has access to technical data:

  • Wfolio (website management and hosting platform provider): Processes technical data necessary for hosting the Website.

Data transfer to third countries (Russian Federation): Due to the fact that the Controller uses the Wfolio platform for the operation of the Website, technical data necessary for displaying the Website are transferred to and stored on servers in the Russian Federation. There is no adequacy decision by the European Commission regarding the level of personal data protection for this country. The transfer and storage of these technical data (such as your IP address) takes place exclusively on the basis of a derogation for specific situations under Art. 49 para. 1 GDPR, as it is strictly necessary for the technical display itself of the portfolio content you requested on the internet.

6. YOUR RIGHTS IN CONNECTION WITH THE PROCESSING Under the GDPR, you as a data subject have the following rights, which you can exercise by contacting the Controller at the e-mail address listed in Article 2:

  • Right of access (Art. 15 GDPR): You have the right to obtain confirmation as to whether or not personal data concerning you are being processed, and which data.
  • Right to rectification (Art. 16 GDPR): If the data about you is inaccurate.
  • Right to erasure / “right to be forgotten” (Art. 17 GDPR): You have the right to request the erasure of your data if the purpose of its processing has ceased to exist.
  • Right to object (Art. 21 GDPR): You have the right to object to processing based on the legitimate interest of the Controller.
  • Right to restriction of processing (Art. 18 GDPR).
  • Right to lodge a complaint: If you believe that the processing of your data has violated the law, you have the right to lodge a complaint with a supervisory authority (Office for Personal Data Protection, Pplk. Sochora 27, 170 00 Praha 7, www.uoou.cz).

7. PUBLISHED PHOTOGRAPHS (PORTFOLIO CONTENT) Photographs of natural persons published on the Website are part of the Controller’s artistic portfolio. The publication is based on:

  • Mutual agreement with the photographed person;
  • Consent of the photographed person (Model Release); or
  • A statutory license for artistic or reporting activities under § 84 et seq. of Act No. 89/2012 Coll., the Civil Code. If you wish to request the removal of your photograph from the portfolio, please contact the Controller at the specified e-mail address.
